KBZPAY CUSTOMER TERMS & CONDITIONS
Kanbawza Bank Limited (KBZ Bank) requires that all persons accessing KBZ Bank’s KBZPay Mobile Financial Services adhere to the following Terms and Conditions. By requesting or using KBZPay Mobile Financial Services of KBZ Bank via KBZPay Application or permitting someone else to use these on behalf of the Customer, the Customers indicate their acknowledgment and acceptance of these Terms and Conditions, which are from time to time subject to changes.
1. DEFINITIONS
The following terms when used in these Terms and Conditions or any document referred to herein shall have the following meaning:
1.1 “Account” means an arrangement with the KBZ Bank that allows the Customer to keep the money at the KBZ Bank.
1.2 “Agent” means a third-party operator who has an Agreement with KBZ Bank to perform certain bank-related functions on behalf of KBZ Bank.
1.3 “Agreement” means these Terms and Conditions as amended by KBZ Bank from time to time, together with the Customer registration form, as directed by the Central Bank of Myanmar.
1.4 “Business Day” means a day other than a Saturday, Sunday, public holiday, or bank holiday in Myanmar.
1.5 “CBM” means the Central Bank of Myanmar.
1.6 “E-Money” means ‘electronic money’ and is a value in Myanmar Kyat, held in the KBZPay Account of Mobile Money for the Customers, Agents, Merchants, and KBZ Bank.
1.7 “E-Wallet Account” means a KBZPay digital wallet account provided by the KBZ Bank that allows Customers to electronically store funds and perform financial transactions.
1.8 “Fees” mean all fees and charges for the use of the Service, as published by KBZ Bank and included in the Schedule of Fees.
1.9 “Inactive Account” means the Customer’s KBZPay Account with no initiated debit or credit transaction for twenty-four (24) months and above will be labeled as Inactive Account, this means that the Customer will no longer be able to access to make Transactions and use the Customer’s KBZPay Account.
1.10 “KBZ Bank” means Kanbawza Bank Limited and all the branches of KBZ Bank, including any branches that shall be set up by KBZ Bank in the future.
1.11 “KBZPay” means the Mobile Financial Services offered by KBZ Bank offered to the Customers via the KBZPay Application and its appointed Agents.
1.12 “KBZPay Account” means a Mobile Financial Services Account provided by KBZ Bank through the KBZPay Application, comprising both an E-Wallet Account and a Transit Wallet for Customer’s digital financial management.
1.13 “KYC” means any “Know Your Customer” identity registration requirements issued by the Central Bank of Myanmar to time and other regulatory authorities in Myanmar.
1.14 “Merchant” means an establishment that accepts Mobile Money for the purchase of goods and services or the payment of bills, including online merchants.
1.15 “MyanmarPay” means a digital QR payment service provided by the Central Bank of Myanmar to enable Customers to accept QR code payments using their mobile wallet for purchases from MyanmarPay Merchants.
1.16 “Mobile Financial Services Account or MFS Account” means a store of value provided by KBZ Bank for the purposes of conducting Transactions related to the Service.
1.17 “Myanmar Kyat” means the official currency of the Republic of the Union of Myanmar.
1.18 “Network Service Provider” means the telecommunications and data services provider used by the Mobile KBZPay Account Holder to communicate and transact with KBZ Bank.
1.19 “Non-registered Services / Over-The-Counter (OTC)” means services provided by KBZ Bank without requiring the Customer’s registration.
1.20 “Payee” means a person who is to receive money.
1.21 “PIN or Personal Identity Number” means a numerical password set by the Customer and used to authorize and authenticate Transactions.
1.22 “POS/Agent or Point-of-Sale/Agent” means a person or entity who enters into an Agent Agreement with KBZ Bank to provide the Service directly to the Customers on behalf of KBZPay.
1.23 “Schedule of Fees” means the document of that name, as varied from time to time by KBZ Bank and published in Limit & Fees of KBZPay Application.
1.24 “Service” means mobile financial services, and in particular the provision of payments and financial services through the use of mobile technology infrastructure including electronic terminals.
1.25 “SIM” means Subscriber Identity Module, which is a microchip device used to authenticate a subscriber on the mobile network.
1.26 “SMS” means short messaging service and is a communication protocol allowing the interchange of short text messages between mobile telephone devices.
1.27 “Transaction” means an action of performing financial or non-financial business activities using a mobile phone including, but not limited to cash in, cash out, transfer domestically/internationally, bill payments, merchant payments, balance inquiry, etc.
1.28 “Transit Wallet” means a KBZPay digital wallet provided by KBZ Bank within the KBZPay platform. The Transit Wallet allows Customers to transfer funds internally between their E-Wallet Account and the Transit Wallet or between the Transit Wallet and any linked KBZ Bank Account. The Transit Wallet facilitates the transfer of funds when the balance in the E-Wallet Account exceeds the maximum required balance set by KBZ Bank.
1.29 “User or Customer” means users who are end-customers of KBZPay.
1.30 “Verification Code” means Customers open KBZPay Application, click send verification code, and then enter 6 digits code via SMS in the Customer’s registered mobile number.
2. DESCRIPTIONS OF SERVICES
2.1 SERVICE OVERVIEW
The purpose of KBZPay is to provide Services to the Customers via KBZPay Application and KBZ Bank’s designed Agents. KBZPay Customers will be able to perform financial services electronically via his/her mobile services and/or at KBZ Bank appointed Agents and via the KBZPay Application.
2.2 SCOPE OF SERVICE LEVEL
KBZ Bank provides services to customers based on their designated types. Each type of customer is required to comply with specific terms and conditions as defined below:
2.2.1 KBZPay Customer – KBZPay Customer is an individual who has attained the legal age of 18. This Customer may request to use KBZPay Accounts for personal purposes. All KBZPay Customers shall comply with all terms and conditions set forth in this KBZPay Customer Terms and Conditions.
2.2.2 KBZPay Youth Customer – A KBZPay Youth Customer is an individual who has reached the age of 16 but is not yet 18. The Youth Customer can open a KBZPay Youth Account only with the consent of a guardian or parent. The KBZPay Youth Customer may use the KBZPay Youth Account under the supervision of their guardian or parent. Transactions made by the Youth KBZPay Customer may be subject to additional verification and approval processes as determined by KBZ Bank. The guardian or parent is responsible for monitoring account activity and ensuring compliance with all applicable terms and conditions. Both the KBZPay Youth Customer and their guardian or parent must comply with all terms and conditions set forth in the KBZPay Youth Customer Terms and Conditions.
2.3 KBZPAY ACCOUNT REGISTRATION
2.3.1 The KBZPay Customer can self-register for KBZPay via his/her mobile phone and can self- upgrade their KBZPay Account in accordance with KBZ Bank KYC policy.
2.3.2 The Customer can onboard and upgrade in accordance with KBZ Bank KYC policy at KBZ Bank appointed Agents or KBZ Bank branches and/or other channels approved by KBZ Bank only.
2.3.3 All the Customers must provide the following required information (Registration Information) in order to complete the registration or upgrade process.;

2.3.3.4 Gender

2.3.3.12 Email Address.
2.3.4 The Customer can link the E-Wallet Account with the KBZ Bank Account in accordance with the guidelines stated in the Limits & Fees table in the KBZPay Application. The Customer agrees to keep the Registration Information up-to-date at all times to ensure its completeness and accuracy.
2.4 TRANSACTION TYPES
KBZPay Customers will be able to perform the following Services with but not limited to

3. OBLIGATIONS OF CUSTOMER AND KBZ BANK
3.1 OBLIGATIONS OF KBZ BANK
3.1.1 KBZ Bank shall ensure that KBZPay Mobile Financial Service is available to the Customer at all times unless the Service is interrupted due to technical difficulties or any circumstances beyond KBZ Bank’s control.
3.1.2 KBZ Bank reserves the right to obtain such additional information as reasonably necessary to ensure that the Customer is not using KBZPay Account in violation of law, including, but not limited to, illegal activities such as gambling, pornography, prostitution, and laws and regulations designed to prevent ‘money laundering’, counter-terrorism financing or the transfer of funds to KBZPay Accounts that are blocked under regulations of the Central Bank of Myanmar and other regulators.
3.1.3 KBZ Bank reserves, at its own discretion, the right to decline the KBZPay Application of the Customer or cease providing the Services to the Customer.
3.1.4 KBZ Bank reserves the right to add, change, move Services offered or suspend the Services to the Customers at its own discretion or under the instructions of the relevant authorities.
3.1.5 KBZ Bank shall set any fees, charges, and Transaction limits associated with KBZPay and will collect according to the prescribed rate. KBZ Bank reserves the full right to change/modify fees, charges, commission, and Transaction limits at its own discretion for any reason at any time without any prior notice.
3.1.6 KBZ Bank reserves the right to automatically block or refuse any Transaction that exceeds the applicable Transaction limits or maximum Transaction amounts set by KBZ Bank.
3.1.7 KBZ Bank may, at its sole discretion and without prior notice, close the KBZPay Account if any Transaction exceeds the established limits or if the Customer repeatedly violates the Transaction limits set by KBZ Bank, in accordance with the rules and regulations of the CBM.
3.1.8 KBZ Bank may close or revoke E-Wallet Account or Transit Wallet or KBZPay Account, and Services, with or without notice to the Customer if the Customer does not follow KBZ Bank’s instructions in connection with the KBZPay Account and Services or the Customer does not comply with these Terms and Conditions or any applicable law.
3.1.9 KBZ Bank reserves the right to freeze or suspend the KBZPay Account, any partial amount or the whole balance within the KBZPay Account, or any Services associated with the KBZPay Account, in accordance with regulations or procedures set by relevant authorities from time to time.
3.1.10 KBZ Bank may implement measures and take actions necessary to comply with all applicable laws, regulations, and directives issued by relevant regulatory or governmental authorities, including but not limited to anti-money laundering (AML) and counter-terrorism financing (CTF) regulations.
3.2 OBLIGATIONS OF THE CUSTOMER
3.2.1 The Customer shall make a KBZPay registration with his own full legal name as described in the NRC or passport.
3.2.2 KBZPay Blue Application usage is limited to only personal purposes and any other purposes are strictly prohibited. Any non-personal name in the name field shall be rejected by KBZ Bank.
3.2.3 The Customer warrants that all personal information contained in the Customer KBZPay registration together with supporting identification documentation is correct, accurate, and up to date.
3.2.4 The Customer shall provide KBZ Bank with any updated personal information together with supporting documentation if the Customer’s personal information changes or if KBZ Bank requests to satisfy KYC requirements or other legal/regulatory requirements.
3.2.5 Any requests to change the mobile phone numbers or change any information of KBZPay Account by the Customers themselves are not allowed. The Customers shall call the KBZPay Call Center and are to follow the instructions.
3.2.6 KBZ Bank identifies the Customers by their unique mobile number and Transaction PIN. All Transactions initiated with the mobile number and Transactions will be attributed to the Customer. If a Transaction PIN/ number is received, and the mobile phone and the registered KBZPay Account are able to be accessed, it shall be deemed that the Customer himself or the authorized person is making the Transaction. KBZ Bank shall not reverse any Transaction once completed if such Transaction is attributed by the Customer.
3.2.7 The Transaction PIN/OTP of the Customer shall be kept secret, and it is the sole responsibility of the Customer to prevent the act of an unscrupulous person to ensure safety. Any consequences arising from disclosing the Transaction PIN/OTP of the Customer or illegally using it by someone is the sole responsibility of the Customer.
3.2.8 The Customer agrees not to give or make available Transaction PIN to any other individuals, including anyone claiming to represent KBZ Bank. The Customer acknowledges that KBZ Bank will never ask the Customer for the Customer’s Transaction PIN and that KBZ Bank employees do not need the Customer Transaction PIN.
3.2.9 KBZ Bank has no responsibility to make remedies for losses or revoking arising out of money exchange with a certain person through KBZPay Account and other financial services applied by Customers.
3.2.10 The Customer is aware, agrees, and acknowledges and confirms that KBZ Bank is required to provide Customer data and Transaction information to any Court or government authorities. when requested.
3.2.11 The Customer acknowledges and agrees that KBZ Bank reserves the right to charge on the Customer’s Inactive Account keeping charges which will be deducted from the Customer’s Inactive Account.
3.2.12 Before making Transactions, the Customer shall thoroughly check the information of the receiver, and KBZ Bank has no responsibility for any loss or harm caused by Transaction errors.
3.2.13 The Customer shall notify KBZ Bank immediately in case the Customer’s mobile phone or SIM is stolen/lost in order for KBZ Bank to block the Customer’s KBZPay Account so that the Service is suspended and unauthorized Transactions are prevented.
3.2.14 The Customer acknowledges and agrees that KBZ Bank has the right to close the Customer’s E-Wallet Account, Transit Wallet, or KBZPay Account at its sole discretion, if the balance in the respective account is zero (0), with or without prior notice to the Customer.
3.2.15 The Customer shall not be permitted by KBZPay in any of the following conduct/activities including, but not limited to, in connection with the use of the Customer’s KBZPay Account:
3.2.15.1 providing KBZPay with false, inaccurate, or misleading information;
3.2.15.2 using the Customer’s KBZPay for any illegal activities;
3.2.15.3 using KBZPay in a manner that may result in complaints, disputes, claims, penalties, or other liability to KBZ Bank, other users, or third parties or may be regarded as abuse or a violation of any services provided by a third party and used by the Customer for potentially fraudulent funding (or withdrawing from) the Customer’s KBZPay Account; or
3.2.15.4 breaching these Terms and Conditions or any applicable laws and regulations.
3.2.16 If the Customer has reasonable cause to believe that he/she has been a victim of fraudulent activities including unauthorized or suspicious use of his/her KBZPay Account, the Customer shall immediately contact the KBZPay Call center to report the incident.
3.2.17 After making investigations by officials of KBZ Bank, the Customer shall cooperate in finding the necessary information. KBZ Bank will inform the Customer on the progress of the investigation through the respective department enabling the Customer to know the latest developments.
3.2.18 If the Customer is suspicious of getting involved in the fraud case, he or she has to cooperate with the appropriate persons in the investigation of KBZ Bank. The Customer must be in a position to submit firm evidence that he or she is not getting involved in the fraud case. If not, the Customer shall follow the sole discretion of KBZ Bank.
3.2.19 The Customer agrees that he/she will provide/disclose necessary information to KBZ Bank to manage fraudulent cases, AML/CFT, or to comply with any other laws in Myanmar, and KBZ Bank will disclose any information of the Customer to relevant authorities when required by law.
3.2.20 The Customer acknowledges and agrees that Transactions may be blocked or refused if the Customer exceeds the established limits or amounts set by KBZ Bank, and KBZ Bank shall not be liable for any losses resulting from such actions.
3.2.21 The Customer agrees to cooperate fully with KBZ Bank and provide all requested information and documentation in a timely manner to facilitate the resolution of issues leading to the freezing or suspension of the account or Services.
3.2.22 The Customer acknowledges and agrees that KBZ Bank shall not be liable for any claims, losses, damages, or expenses arising out of or in connection with KBZ Bank’s exercise of its rights to freeze or suspend the Account, wallet, part or the whole balance of the KBZPay Account, or any Services provided under these Terms and Conditions.
3.2.23 The Customer agrees to provide all necessary information and cooperate with KBZ Bank to ensure compliance with applicable laws, regulations, and internal policies, including providing any required documentation or evidence.
3.2.24 The Customer agrees that the Customer gives KBZ Bank consent to collect, use, disclose, and retain his/her personal information and other information. By using the Service, the Customer agrees to KBZPay’s Terms and Conditions.
3.2.25 The Customer acknowledges and agrees to send all information including but not limited to information about Campaign and Marketing on this service, to the mobile phone of the Customer through SMS and SMS link.
3.2.26 KBZPay users who use MMQR must also comply with the terms and conditions of Myanmar Pay set forth in the Appendix of the Terms and Conditions for KBZPay Users.
4. HOURS OF OPERATION
4.1 The Customer’s Transaction available time is 24 hours on Business Days at the moment. However, this may be subject to change according to unforeseen situations in the future and the Customer agrees to check from time to time. The Customer understands that KBZ Bank will have to perform periodic maintenance to the hardware and software used to provide Services, which may cause temporary Service interruptions. The Customer acknowledges that KBZ Bank has no obligation whatsoever to furnish any maintenance and support services with respect to the KBZPay.
4.2 The Customer hereby authorizes KBZ Bank to automatically transfer all amounts exceeding the maximum balance of the Customer’s E-Wallet Account to the designated Transit Wallet at the date and time set by KBZ Bank (“Auto-Sweep”). The Customer agrees to designate the Transit Wallet for the Auto-Sweep functionality from the E-Wallet Account.
4.3 The Customer shall transfer all amounts exceeding the maximum balance from the E-Wallet Account to the linked KBZ Bank Account or Transit Wallet before the date and time set by KBZ Bank for Auto-Sweep. In the event that the Customer fails to transfer all amounts exceeding the maximum balance of the E-Wallet Account before the date and time set by KBZ Bank for Auto-Sweep, KBZ Bank is hereby authorized to automatically transfer the excess amounts to the designated Transit Wallet at the specified date and time in accordance with this Clause.
4.4 KBZ Bank reserves the right to change or amend the Transaction limit and maximum balance of the E-Wallet Account, including but not limited to the maximum number of Transactions and the maximum Transaction amount permitted per day, at any time, at its sole discretion, with or without prior notice to the Customer. KBZ Bank may update or modify the timeline for the Auto-Sweep functionality. The Customer agrees to comply with all instructions and notifications provided by KBZ Bank regarding these changes. KBZ Bank reserves the right to temporarily suspend or permanently discontinue the Auto-Sweep functionality, with or without prior notice to the Customer.
4.5 The Customer agrees to comply with all instructions, notifications, and amendments provided by KBZ Bank concerning the Transaction limit, maximum balance, and Auto-Sweep functionality of the E-Wallet Account, including the maximum number of Transactions and the maximum Transaction amount permitted per day.
4.6 KBZ Bank shall not be liable for any loss or damage arising directly or indirectly from the execution of the Auto-Sweep functionality, including but not limited to delays or errors in processing.
4.7 KBZ Bank shall not be responsible for any failure to execute the Auto-Sweep due to circumstances beyond its control, including but not limited to technical malfunctions, system failures, or interruptions in Service.
4.8 KBZ Bank will communicate any changes or updates to the Auto-Sweep functionality via email, SMS, or through KBZ Bank’s official website. The Customer is responsible for regularly checking for such communications and ensuring that their contact information is up to date.
5. DIRECT DEBIT AUTHORIZATION
The Customer hereby agrees and irrevocably authorizes KBZ Bank to debit the relevant amount, by means of payment service procedure, from the Customer’s Bank Account for any disputes arising out from the access and usage of KBZPay. Furthermore, if a dispute occurs and if there are no or not enough funds in the Customer’s Account, the Customer agrees to credit the amount and other relevant amounts to their Account.
6. FORCE MAJEURE
The Customer understands that KBZ Bank shall not be liable for any failure of or delay in the performance of these Services for the period that such failure or delay is due to causes beyond its reasonable control, including but not limited to acts of God, war, strikes or labor disputes, embargoes, government orders, fire, flood, torrential rain, storm or other extreme weather conditions, riot, insurrection, civil commotion, sanctions, boycott, failure of electricity, equipment failure, or any other force majeure event. KBZ Bank’s performance of these Services will, to the extent that it is prevented, hindered, or delayed by such circumstances, be suspended until such circumstances cease to exist. KBZ Bank will not be liable to the Customer or any other party or be considered in breach of these Terms and Conditions for a failure to perform, or delay in performing, any such obligation set out in these Terms and Conditions while those circumstances continue.
7. ANTI-MONEY LAUNDERING AND SANCTIONS
7.1 KBZ Bank is subject to anti-money laundering laws in the Republic of the Union of Myanmar and certain countries, which may prohibit KBZ Bank from entering or concluding Transactions involving certain persons or entities.
7.2 The Customer must provide all information required by KBZ Bank in order to manage its anti-money laundering or counter-terrorism financing and risks from the economic trade sanctions or to comply with any other laws and regulations of the Republic of the Union of Myanmar.
7.3 The Customer declares and undertakes that the process of any Transactions by KBZ Bank will not breach any of the laws in Myanmar or any other country.
8. LIMITATION OF LIABILITY
8.1 KBZ Bank will process and complete all Transactions initiated that comply with these Terms and Conditions. However, KBZ Bank shall not be liable if KBZ Bank is unable to complete any Transaction initiated by the Customer because of the existence of one or more of the following circumstances:
8.1.1 The Customer’s KBZPay Account or Bank Account does not contain sufficient funds to complete the payment;
8.1.2 The KBZPay Application Service, the communication line, the mobile device, or modem was not functioning properly, and the Customer knew about the malfunction or was advised of it by KBZ Bank when the Customer started the Transaction;
8.1.3 The Customer did not properly initiate the Transaction or provide KBZ Bank with the correct names and account information for those Payees to which the Customer wishes to direct payment;
8.1.4 Circumstances beyond KBZ Bank’s control (such as, but not limited to, fire, power outage, equipment or technical breakdown, flood, or other outside force) prevent the proper execution of the Transaction;
8.1.5 The Customer instructs KBZ Bank to make a type of payment, such as tax payment or Court-ordered payment, which KBZ Bank cannot make;
8.1.6 The funds are subject to legal process or other hold or encumbrance restricting such transfer.
8.2 KBZ Bank will not be liable to the other for any loss of profits, loss of data, loss of use, cost of cover, business interruption, or other special and incidental, indirect punitive, or consequential damages. However, caused, under the theory of liability, arising from the performance or relating, to these Terms and Conditions, unless the party causing loss did so willfully, negligently, or without the due care and skill required for someone in the position of that party.
9. RIGHT TO SET OFF
The Customer is obliged to return any excess funds inaccurately credited due to erroneous Transactions by a third party or by KBZ Bank or for any reason. Where such funds do not rightfully belong to the Customer, KBZ Bank may deduct such excess deposits without any restriction, notice, or by all reasonable other means.
10. INTELLECTUAL PROPERTY
KBZ Bank is an owner of all intellectual property rights, whether in contents or wording, pictures, signs, logo, trade service marks, trade names as well as all design works, in all documents, websites of KBZ Bank, and KBZPay Application. The Customer must not exploit the intellectual property right of KBZ Bank or make any advertisement without receiving prior written consent from KBZ Bank. The Customer shall not perform or allow any third party to perform any action that might cause damage to the image, trademark, trade name, or other intellectual property right of KBZ Bank.
11. TERMINATION
KBZ Bank may suspend or terminate the Service at any time, with or without cause and without affecting the Customer’s outstanding obligations under these Terms and Conditions. KBZ Bank may immediately take this action if the Customer breaches this or any other agreement with KBZ Bank; KBZ Bank has reason to believe that there has been or may be unauthorized or illegal use of the KBZPay Account or the Service; as instructed by CBM or respective regulatory authorities; there are conflicting claims to the funds in the KBZPay Account. KBZ Bank will check all Customers’ Account(s) information with KBZ Bank and has the right to deduct the accrued amount on any Accounts Customers hold with KBZ Bank.
12. INACTIVE ACCOUNT POLICY
12.1 If the Customer does not make any Transaction for twenty-four (24) months and above, the Customer’s KBZPay Account will have converted from an active account to Inactive Account and the Customer will no longer be able to access the Customer’s KBZPay Account. KBZ Bank has the right to deactivate/suspend or close the Inactive Accounts or Dormant Accounts that remain zero (0) balance or have less than and equal to 500 MMK as a minimum balance. The Services provided to the Customer will be automatically terminated with or without giving notice to the Customer when the Customer’s KBZPay Account is closed.
12.2 After twenty-four (24) months of being an Inactive Account of KBZPay Customer with over 500 MMK, KBZ Bank will charge the Customer’s Inactive Account keeping charges 500 MMK per month during inactive status and it will be deducted from the Customer’s Inactive Account monthly for those Accounts over 500 MMK. KBZ Bank will allow the Customer to reactivate the Inactive Account before the Customer’s Inactive Account is closed.
12.3 If Inactive Account Customer who wants to reactivate his/her Inactive Account would need to visit physically the nearest KBZ Bank branches or KBZPay centers to fill up the form and request accordingly and shall fulfill all KYC (Know Your Customer) formalities required by KBZ Bank. The Customer acknowledges that KBZ Bank policies and procedures may be amended from time to time. KBZ Bank will proceed with the Inactive Account activation process at the Customer’s request in accordance with the policies and procedures of KBZ Bank.
13. DATA PRIVACY
13.1 KBZ Bank collects and uses personal information from the Customer when the Customer register for KBZPay Account, use the KBZPay Account for financial transactions, or KBZPay Services. The Customer’s personal information that KBZ Bank collects including Registration Information: the Customer’s name, date of birth, address, phone number, National Registration Card (NRC) or Valid Passport Information and Photos, biometric information, email address, and other contact information or any other and any other identifying information of the Customer (hereinafter referred to as “Privacy Data”) relating to the use of KBZPay Application provided that, any information that is freely available or accessible in the public domain shall not be regarded as sensitive Privacy Data or information. KBZ Bank understands that the Customer’s Privacy Data is important to the Customer and KBZ Bank values Customer’s trust in Privacy Data, thus KBZ Bank will use commercially acceptable means of protecting it. KBZ Bank will use the information collected from the Customer for several lawful purposes such as;
13.1.1 Processing applications and Transactions.
13.1.2 Verifying the Customer’s identity (such as when the Customer accesses the Customer’s KBZPay Account information).
13.1.3 Preventing fraud and enhancing the security of the Customer’s KBZPay Account or Services.
13.1.4 Responding to the Customer’s requests and communicating with the Customer.
13.1.5 Complying with and enforcing applicable legal requirements, relevant industry standards, contractual obligations, and KBZ Bank’s policies.
13.2 KBZ Bank may retain the Customer’s Privacy Data for a longer period (including after the Customer is no longer a User), if it is necessary to comply with laws and regulations applicable to KBZ Bank. KBZ Bank uses a variety of security measures and technologies designed to help protect Customer’s Privacy Data from unauthorized access, use, disclosure, alteration, or destruction consistent with applicable laws and regulations.
13.3 The Customer hereby authorizes and agrees to KBZ Bank to exchange, share, and utilize the services of necessary third parties (external service providers or agents) and disclose the Customer’s Privacy Data to such third parties on such terms and conditions as required or part with all the information relating to the Customer, biometric information, account information and all information pertaining to the Customer or as expressed in the application made for availing the banking services to its Affiliates, banks, financial institutions, credit bureaus, agencies, and statutory bodies.
13.4 This Clause 13 relating to Privacy Data is part of the terms and conditions and is subject to change and any changes to this Clause 13 will become effective once the Customer agrees on these Terms and Conditions.
14. SECURITY
KBZ Bank is committed to protecting the security and confidentiality of information about the Customer’s KBZPay Account and use of KBZPay. KBZ Bank has taken reasonable and appropriate measures to ensure that any personal information is always secure in the KBZPay system. However, KBZ Bank cannot guarantee that the public personal information that may have previously been provided will not be intercepted by others and unencrypted or compromised. KBZ Bank will not be held liable for any security breach that occurs for reasons outside of its control.
15. DISCLAIMER
15.1 To the fullest extent permitted by law, the KBZ Bank makes no representations or warranties of any kind in respect of the Service, either express or implied, statutory or otherwise, including but not limited to implied warranties of merchantability or fitness for a particular purpose, and the KBZ Bank hereby disclaims any such representations, warranties, and conditions of any kind.
15.2 The KBZ Bank shall not be liable for any authorized Transactions occurring through the use of the facility and the Customer hereby fully indemnifies and holds the KBZ Bank harmless against any action, suit, proceeding initiated against it or any loss, cost, or damage incurred by it as a result thereof.
16. WARRANTY
As a condition of the use of Services, the Customer warrants to KBZ Bank that the Customer will not use Services for any unlawful purpose. The Customer agrees to abide by all applicable laws, rules, regulations, and statutory requirements regarding the use of Services.
17. ASSIGNMENT AND SUCCESSORS
The Customer may not assign or transfer any of its rights or obligations under these Terms and Conditions either in whole or in part, to any third party without the prior written consent of KBZ Bank. KBZ Bank shall have the right at all times to assign or transfer any of its rights or obligations under these Terms and Conditions either to any assigns or successors of KBZ Bank.
18. AMENDMENT
The Customer acknowledges that KBZ Bank reserves the right to amend, modify, or substitute any provisions of this Terms and Conditions or to the Services and/or any charges at any time for any reason at its sole discretion and without any prior notice. The Customer shall be responsible for regularly reviewing these terms including amendments thereto as may be posted on the Website or KBZPay Application. Any use of these Services after a change or changes take effect will constitute these Terms and Conditions to such changes.
19. WAIVERS
Failure or delay on the part of either party to enforce any provision(s) of these Terms and Conditions at any point of time shall not be construed to be a waiver by such party of such rights thereafter to enforce each and every provision of these Terms and Conditions.
20. SEVERABILITY
Each of the provisions of these Terms and Conditions shall be several and distinct from one another. If any of the provisions of these Terms and Conditions becomes invalid, void, illegal, or unenforceable in any respect under any law, the validity, legal, and enforceability of the remaining provisions shall not in any way be thereby affected or impaired.
21. NO RELATIONSHIP
Nothing in these Terms and Conditions shall be construed as to create the relationship of employer-employee, partners, collaborators, joint-venture, or principal-merchant between the parties hereto. The parties shall be independent contractors and neither party shall bind the other by its acts, deeds, or omissions.
22. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms and Conditions shall be governed by, and construed in accordance with, the laws of the Republic of the Union of Myanmar, and the Courts in Myanmar shall have exclusive jurisdiction to solve any dispute arising from or under these Terms and Conditions.
23. LANGUAGE
These Terms and Conditions are made in both English and Myanmar and both versions shall be equally authentic and effective. In case of any discrepancy between the two versions, the Myanmar version shall prevail.

MyanmarPay T erms and Conditions
Welcome to MyanmarPay, a digital QR payment service provided by Central Bank of Myanmar. By using our service, User agrees to comply with and be bound by the following terms and conditions. Please read them carefully.
1. Acceptance of Terms
By using MyanmarPay, User acknowledges that you have read, understood, and agree to be bound by these terms and conditions, as well as any future modifications.
2. Consumer Consent for Data Sharing
2.1 Data Sharing: By using MyanmarPay, User consents to the collection, use, and sharing of your personal and transaction data by MyanmarPay in accordance with our Privacy Policy. This includes the sharing of data with the Central Bank of Myanmar and other third parties as required for regulatory and operational purposes.
3. Compliance with Central Bank of Myanmar Policies
3.1 Regulations: User agrees to comply with all applicable laws and regulations, including but not limited to those set out by the Central Bank of Myanmar.
3.2 Policy Updates: MyanmarPay will notify user of any changes to policies mandated by the Central Bank of Myanmar. Continued use of the service after such notification constitutes your acceptance of the changes.
4. Pricing, Fees and Rewards
4.1 Pricing and Fees: MyanmarPay reserves the right to set and modify pricing or fees for its services. Any changes will be communicated to you in advance.
5. User Responsibilities
5.1 Account Security: Users are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account.
5.2 Prohibited Conduct: Users agree not to engage in any activity that could harm MyanmarPay or its users, including but not limited to fraudulent activities, money laundering, or any other illegal activities.
6. Limitation of Liability
MyanmarPay is provided on an “as is” and “as available” basis. To the fullest extent permissible by law, MyanmarPay disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Indemnification
Users agree to indemnify, defend, and hold harmless MyanmarPay, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your access to or use of the service.
8. Force Majeure
MyanmarPay shall not be liable for any failure to meet obligations under these terms if such failure results from extraordinary and unforeseeable events beyond its control. These events may include, but are not limited to, natural disasters, fires, floods, wars, acts of terrorism, actions by governmental or public authorities, strikes or other industrial disputes not involving MyanmarPay employees, equipment failures, software malfunctions, disruptions in communication networks (whether owned by MyanmarPay or third parties), interruptions in third-party power supplies, or disturbances in the international systems through which transactions are conducted, where the impacts of such events are unavoidable despite MyanmarPay’s best efforts.
9. Sanctions
MyanmarPay reserves the right to decline instructions, refuse to process payments, or take any necessary actions related to a transaction if it reasonably believes that doing so may be required to comply with legal or regulatory obligations. In such cases, MyanmarPay will not be liable for any resulting loss, damage, cost, or expense. Additionally, MyanmarPay is authorized to disclose any necessary information to relevant authorities concerning a payment instruction or account as required.
10. Termination
MyanmarPay reserves the right to terminate or suspend your access to the service, with or without prior notice or liability, for any reason whatsoever, including without limitation if you breach the terms.
11. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the Republic of the Union of Myanmar. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in Myanmar.
12. Changes to Terms and Conditions
MyanmarPay may update these terms and conditions from time to time. Users will be notified of any changes, and your continued use of the service after such notification will constitute your acceptance of the revised terms.
